The Two Power of Attorney Documents Most Georgians Need

Georgia recognizes two primary instruments, and most complete estate plans include both. They cover different areas of life, and neither automatically grants the authority of the other.

Financial Power of Attorney
Governed by the Georgia Power of Attorney Act (O.C.G.A. Title 10, Chapter 6B), a financial power of attorney authorizes your chosen agent to manage money, property, banking, real estate transactions, taxes, and business affairs. The agent can only act on powers you expressly grant in the document. Banks and financial institutions are generally required to honor a validly executed financial power of attorney under Georgia law; they may refuse only for specific, good-faith reasons, such as a reasonable belief the document is forged or that the agent is committing financial abuse. If your power of attorney covers real estate, it must be recorded with the Barrow County Clerk of Superior Court.

Advance Directive for Healthcare
Georgia replaced the older durable power of attorney for health care and living will forms with a single document called the advance directive for healthcare. This is the Georgia-correct term for what many people call a “medical power of attorney.” It governs medical decision-making and is a completely separate document from your financial power of attorney. Durable vs. Springing: Choosing When Your POA Takes Effect

One of the most important decisions in drafting a financial power of attorney is choosing when it takes effect. Under O.C.G.A. Section 10-6B-4, a Georgia power of attorney is durable by default, meaning it remains valid even if you later become incapacitated. A non-durable power of attorney terminates at incapacity and is typically used only for specific short-term transactions.

Within durable powers of attorney, you also choose between two activation options. A present or immediate power of attorney takes effect the moment you sign it. A springing power of attorney takes effect only upon a triggering event, typically incapacity as certified in writing by a physician or licensed psychologist. The right choice depends on how much ongoing access you want your agent to have and how much oversight you want to maintain while you’re still fully capable.

Georgia’s Execution Requirements for a Valid Power of Attorney

A financial power of attorney in Georgia must meet specific formality requirements to be valid. The document must be signed by the principal, witnessed by at least one competent adult who is not named as the agent, and notarized. Under O.C.G.A. Section 10-6B-5, the witness and the notary must be two separate individuals. If you’re unable to sign, another person may sign at your direction and in your presence.

Any person who is at least 18 years old and has the mental capacity to understand what they’re signing may create a power of attorney in Georgia. That capacity requirement matters: a power of attorney signed after incapacity has already set in may not be valid, which is exactly why waiting creates risk. DIY templates frequently produce documents that are ambiguous, miss Georgia-specific requirements, or get rejected by financial institutions when the agent actually needs to use them.

When to Review or Revoke a Power of Attorney

Several life events should prompt a review of your existing documents: marriage, divorce, the birth or adoption of a child, a significant change in health, relocating to another state, or a major shift in financial circumstances. If your named agent passes away, the authority granted under that document ends. A successor agent named in the original document may then step in, but only if the document was drafted to account for that possibility.

To revoke or amend a Georgia power of attorney, you must execute a new document clearly stating the revocation or change, signed according to Georgia’s execution requirements. After revoking a financial power of attorney, it’s advisable to notify any financial institutions that had a copy on file, as well as any successor agents named in the original document.
