What Georgia Law Requires for a Valid Will

Georgia has clear statutory requirements for a will to be enforceable. Under O.C.G.A. Section 53-4-20, the document must be in writing and signed by the testator in the presence of at least two competent witnesses, who must also sign. Georgia doesn’t recognize holographic wills, meaning a handwritten document signed without witnesses carries no legal weight here. The testator must be at least 14 years old and of sound mind, with a decided and rational desire to dispose of property (O.C.G.A. Sections 53-4-10 and 53-4-11).

One drafting mistake worth avoiding: naming a beneficiary as a witness. Under O.C.G.A. Section 53-4-23, that beneficiary’s gift can be voided unless at least two other disinterested witnesses also signed. Professional preparation can catch these issues before they become problems.

The Self-Proving Affidavit

A notary isn’t required for a valid Georgia will, but adding a self-proving affidavit, signed before a notary at execution, means the will can be admitted to probate without requiring witness testimony later. Under O.C.G.A. Section 53-4-24, this can meaningfully simplify probate, particularly when witnesses are difficult to locate years after signing.

  • Testamentary trustee: A person appointed to protect a child’s inheritance until they reach a designated age

It’s equally important to understand what a will doesn’t govern. Assets with designated beneficiaries, such as life insurance policies and retirement accounts, pass outside the will entirely. The same applies to assets already titled into a trust. A pour-over will can serve as a safety net, directing any assets not already in a trust to flow into it at death. We can also coordinate your will with companion documents such as trusts, advance directives, and powers of attorney as part of a complete estate plan.
